Income Navigator
- Income Navigator™ reports. End user agrees to use Income Navigator™ reports as provided by MRI Software LLC (“MRI”) and compiled by Nova Credit Inc. (“Nova”).
- Permissible Purpose. End user agrees that, as an express condition of accessing and using Income Navigator™ reports, it shall do so solely for the purpose of verifying income or employment information in connection with an application for rental housing, and in accordance with the Agreement, this Exhibit, the Fair Credit Reporting Act (“FCRA”), all other applicable laws and regulations (the “Permissible Purpose”).
- Report Usage. End user agrees that each Income Navigator™ report shall only be used in connection with the Application for which it is retrieved.
- Permissioned Data Availability. End user acknowledges that for any applicant from whom it may request an Income Navigator™ report, Nova will provide such a report only if able to obtain the applicant’s relevant data necessary to compile such a report.
- As-Is Warranty. MRI does not guarantee or warrant the accuracy of the data received from Nova or the applicant, and Nova does not guarantee or warrant the accuracy of the data received from the applicant.
Consumer Report Provisions
Where the Services to be provided by Nova are identified in an Order Form as including the provision of Consumer Reports, Client understands, acknowledges and agrees that it shall comply with and be bound by the additional supplemental requirements (the “Consumer Report Requirements”) (as applicable):
a)Applicable Laws. Client specifically agrees that it will order and use Consumer Reports received hereunder only in accordance with the Fair Credit Reporting Act, 15 U.S.C. 1681, et seq, and any implementing regulations thereof (“FCRA”), and all applicable state law counterparts, and specifically only in connection with a credit transaction involving the consumer Applicant to whom such Consumer Report relates and involving the extension of credit to, or review or collection of an account of, such Applicant (the “Permissible Purpose”). Client will not compile, store, use, transfer, distribute, or resell Consumer Reports for any other purpose including, but not limited to, for any marketing purposes or for transfer to any third party. Client’s compliance with the FCRA, also includes, as applicable, the furnisher and user requirements described in Appendices M and N to the Consumer Financial Protection Bureau’s Regulation V, respectively; the Federal Trade Commission’s Disposal Rule, 16 C.F.R. Part 682; the Gramm–Leach–Bliley Act, 15 USC §
6801, et seq, and any implementing regulations thereof (“GLBA”); and all other applicable laws, rules, regulations, and orders that pertain to Client’s use of the Nova Information and data contained therein.
b)Applicant Authorization. Client will refer individual consumers to the online interface Nova provides to Client (“NovaConnect”). Client represents and warrants that Client has reviewed the NovaConnect interface and acknowledges and agrees that, as between the parties, Client is solely responsible for its consumer application process that incorporates NovaConnect. Client represents and warrants that it will include in such application process all appropriate consents or disclosures necessary for individual consumers to utilize NovaConnect and that Client’s use of NovaConnect will, in conjunction with the information provided or collected directly by Client in such application process, include all legally required disclosures, consents and authorizations appropriate for Client’s consumer application, website or other services; provided, however, that Nova agrees it will obtain through NovaConnect appropriate consent to access the Applicant’s Consumer Report from a foreign credit bureau and provide such Consumer Report to Client for the Permissible Purpose.
c)Confidentiality. Client may discuss information in a Consumer Report with an Applicant when Client has taken adverse action (as such term is defined in the FCRA) against the Applicant based upon the Consumer Report; Client shall not otherwise provide a copy of a Consumer Report to an Applicant, unless required by law or approved in advance in writing by Nova.
