Lease Admin Nightmares: Ep 7 – Conflicting Clauses, Confused Payments

One document said one thing. Another said the opposite. And our payments? A confusing mess that no one could explain. 

The Setup: A Simple Amendment—Or So We Thought 

The original lease was straightforward. Then came an amendment that adjusted rent escalations. 

We uploaded it, noted the changes, and moved on. The problem? We didn’t fully replace the original clause—we added to it. Now, two sets of terms coexisted. 

No one realized how much that would cost us. 

The Confusion Builds 

The landlord began issuing invoices based on the new escalation schedule—but left some old language in play when it benefited them. 

Some charges reflected the original rent formula. Others used the new one. Our accounting team was baffled. The numbers didn’t reconcile, and the landlord insisted they were correct. 

A Tangle of Terms 

We launched an internal audit and legal review. Sure enough, both clauses technically remained active—and the landlord was picking and choosing whichever version yielded higher rent. 

And because our system hadn’t fully overwritten the original clause, our own team had been approving partial overpayments. 

The Costly Consequences 

It took three months of back-and-forth to resolve. In the meantime, we’d overpaid by thousands, miscalculated our budget forecast, and lost trust from our leadership team. 

All because one amendment wasn’t properly abstracted and reconciled. 

Lessons Learned from the Paper Trail Puzzle 

  • Fully restate amended terms and retire obsolete language
  • Reconcile lease clauses during abstraction, not after invoicing
  • Avoid assumptions—one small contradiction can cost big
