BY COMPLETING THE ELECTRONIC ACCEPTANCE PROCESS AND CLICKING THE “CONTINUE” BUTTON, YOU REPRESENT AND WARRANT THAT YOU: ARE AUTHORIZED TO SIGN FOR AND BIND THE CONTRACTING PARTY AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.

1. DESCRIPTION OF SERVICE
CTM eContracts is an online software application which allows you to create and write interactive digital real estate contracts for the state of Colorado. It also includes a powerful management tool containing a calendar that can track and manage real estate transaction deadlines, client databases, document management, and title orders electronically.
2. REGISTRATION
To use the Service, You must submit a complete CTM eContracts Online registration form, which is available at Sign Up link, on Your behalf As part of the registration process for the Service, You agree to: (1) provide certain limited information about You as prompted to do so by the Service (such information to be current, complete and accurate) and (2) maintain and update this information as required to keep it current, complete and accurate. The information requested on original Sign Up shall be referred to as registration data (“Registration Data”).
If CTM Software discovers that any of Your Registration Data is inaccurate, incomplete or not current, CTM Software may terminate Your right to access and receive the Service immediately upon notice. CTM Software will evaluate the registration application in good faith and will notify You in a timely manner regarding acceptance or rejection. CTM Software may reject a registration application if it determines, in its sole discretion, that the user is not an appropriate subscriber or user of the Service. CTM Software reserves the right to refuse the Service to any user who has canceled any number of previous Service accounts. CTM Software need not provide a reason for its rejection. If CTM Software rejects Your registration, then You may reapply and CTM Software will reconsider the application. You may not register for this Service if You are under 18 years of age. By registering for this Service You represent to CTM Software, that You are 18 years of age or older. Upon acceptance of this agreement and completion of the registration process You will have opened an account with CTM Software Online and will become a subscriber to the CTM eContracts Online Service.
3. SOFTWARE LICENSE
You are signing up for a SINGLE LICENSE, you cannot have more than one USER using your account. If you work with other users, each user must sign up and get their own license or you can sign up for a Team Member License. If CTM Software discovers that you are sharing your account with other users, CTM Software reserves the right to cancel your account immediately and it will not refund your subscription payment. If you work with a team of users and all the contracts are under only one user, you must sign up for a Team Member License. (Please refer to Pricing for all Licenses offered). The maximum number of contracts per year per account is 700 regardless if the contracts have been deleted or hidden. If an account exceeds this maximum number of contracts per year, then the account is subject to pay a Team License which is a reduced price from paying 2 licenses or 3 licenses. License Assistances using the account must pay for a Team License which is a reduced price from paying 2 licenses. Non License Assistances can use an account as long as the user account does not exceeds the maximum number of contracts per year otherwise the account is subject to pay a Team License which is a reduced price from paying 2 licenses or 3 licenses.
CTM Software is not obligated to keep all your data (contracts, clients, etc.) and reserves the right to delete all your data once your account is inactive or no payment has been received.
Recovery: CTM Software reserves the right to charge you to recover any data (contracts, etc.) that have been deleted. The recovery fee will be indicated at the time of the recovery and may vary based on the document type, etc.
4. PAYMENTS
(a) Fees and Payments. You can always find the current Subscription Fees and charges posted under Pricing hyperlinks on the CTM eContracts Web site. Your subscription will continue and renew automatically unless terminated by CTM eContracts Online or until You notify CTM eContracts Online of Your decision to change Your subscription renewal. Prices are subject to change without notice.
(b) Cancellation – Refund.
You can cancel your account at any time during the 30 Days Free Trial Period. After the 30 Days Free Trial Period you can cancel your account but CTM eContracts will not refund the annual subscription fee.
The subscription fees will be to the credit card designated during the subscription payment process for CTMeContracts.com., or subsequently designated to CTMeContracts Online at the start of the subscription period and at the start of each renewal period, unless You terminate Your subscription before the relevant period begins. You agree to pay or have paid all fees and charges incurred in connection with Your subscription for CTMeContracts.com at the rates in effect when the charges were incurred. All fees and charges are nonrefundable outside the Trial Period. All fees and charges incurred in connection with Your user name and password will be billed to the credit card designated during the registration process for CTMeContracts.com.
You also are responsible for any fees or charges incurred to access CTMeContracts.com through an Internet access provider or other third party service. YOU, AND NOT CTMeContracts, ARE RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY, WHICH WERE NOT AUTHORIZED BY YOU. This Agreement is personal to You, and You may not assign Your rights or obligations to anyone.
(c) Credit Cards. As a condition to your right to use the Service, You must provide us with a valid credit card number belonging to you with available credit sufficient to pay the applicable Service Fees. In the event that you cancel this credit card or it is otherwise terminated, you must immediately provide us with a new valid credit card number. You authorize CTMeContracts Online, from time to time, to undertake steps to determine whether the credit card number you have provided to us is a valid credit card number. In the event that you do not provide us with a current valid credit card number with sufficient credit upon request during the effective period of this Agreement, you will be in violation of this Agreement, and we may terminate this Agreement with You. You hereby represents, warrants and authorize CTM Software Corp. to bill your credit card account in the manner, for the amounts and for the period of time indicated by CTM Software for the CTM eContracts license at the time you create your CTM eContracts account or after you created your account.
CTMeContracts (CTM Software) is integrated with Banks and Gateway institutions to process your credit card payment and CTM Software does NOT store any of your credit card information in our servers.
(d) Trial Offers. The Free Trial Offer is ONLY for new accounts and it is NOT available to existing customers or transfer accounts. CTMeContracts Online reserves the right to discontinue or modify Free Trial offer associated with CTMeContracts Personal entitles new, registered subscribers to a one-time free trial usage of the service. Free Trial terms vary by promotional offer. CTMeContracts will notify you prior to your 30 day free trial expiration. Once notified the system will direct you to a screen where you can input your credit card info for payment and continuation of the service. If You wish to terminate the trial and do not wish to subscribe to a plan, You must cancel before the end of your trial period. For cancellation instructions, log in to your account and click on Utilities, then click on Account: Payments – Cancel Account.
